These Terms & Conditions (“Terms”) govern your use of Release My Super’s services. By engaging Release My Super (“RMS”, “we”, “us”, “our”), you agree to these Terms.


1. Who We Are

Release My Super is an Australian-owned business that assists individuals in applying for the early release of their superannuation on compassionate grounds to fund approved medical treatments. We are independent of the Australian Taxation Office (ATO) and superannuation funds.


2. Scope of Our Service
  • We assist clients by coordinating medical assessments, preparing documentation, and submitting compassionate release applications to the ATO.

  • Our end-to-end service extends beyond ATO approval. We actively liaise with your superannuation fund to manage the second phase of the process and ensure funds are released into your nominated bank account.

  • We do not provide financial, legal, or taxation advice. We encourage clients to seek independent advice where appropriate.


3. Fees
  • The total cost of our service depends on:

    • The type of treatment you are seeking to fund through your super

    • Whether you use our end-to-end service with our medical practitioners or choose to involve your own doctors

    • Any additional requirements set by the ATO or your superannuation fund

  • A Schedule of Fees is available and will be explained to you in detail by one of our client services representatives before you proceed. This ensures full transparency and allows us to provide an accurate breakdown tailored to your situation.

  • There are no hidden costs.


4. Refunds & Guarantee
  • End-to-End Service Guarantee: When you engage Release My Super for the full end-to-end service (including medical assessments with our psychiatrists and GPs), we guarantee ATO approval.

  • If you choose to use your own medical practitioners or handle parts of the application independently, we cannot guarantee approval.

Refund eligibility:

  • Once a client has been onboarded and the invoice paid, our team commences work immediately. For this reason, refunds are assessed on a case-by-case basis, taking into account the hours and work already completed on your file. In such cases, a partial refund may be provided.

  • If medical assessments have taken place but you choose not to proceed further, you may be entitled to a partial refund (less the cost of completed assessments).

  • Once your application has been submitted to the ATO, all fees are non-refundable.


5. Timeframes
  • With our end-to-end service, funds are typically released into your bank account within 4 weeks of us commencing your application.

  • Processing times may vary depending on the ATO and your superannuation fund. While we act promptly at every stage, RMS cannot be held responsible for delays caused by third parties.


6. Your Responsibilities
  • You must provide accurate, complete, and truthful information when engaging our services.

  • You are responsible for any tax implications of accessing your super early. We strongly recommend seeking independent financial or taxation advice.

  • You must promptly provide requested documentation (such as identification, treatment quotes, or medical records) to avoid delays.


7. Privacy
  • We respect your privacy and handle personal information in accordance with our Privacy Policy.

  • By engaging RMS, you consent to us collecting and sharing relevant information with medical practitioners, the ATO, and your superannuation fund for the purposes of processing your application.


8. Limitations of Liability
  • While RMS guarantees approval when using our end-to-end service, the final decision to release funds rests with the ATO and your superannuation fund.

  • RMS is not liable for:

    • Tax outcomes from the release of superannuation

    • Delays caused by the ATO, your superannuation fund, or third parties

    • Any losses arising from inaccurate or incomplete information provided by you


9. Amendments

We may update these Terms from time to time. The latest version will always be available on our website.
